What this covers

This policy applies to any copyrighted work that might appear on The Night App — photos, videos, stories, music or other audio, text, and any other content a user or venue uploads. It sits alongside our Terms of Service, which you agree to when you use the app.

You’re responsible for what you upload

You must not upload content you don’t have the necessary rights or permission to use. This includes photos and videos of other people, and any music or audio in them. Uploading something to The Night App doesn’t make it lawful to use, and posting a video doesn’t transfer any rights in the content it contains to you or to us.

Music and audio in videos

The Night App lets people record video at nightlife venues, and that video can incidentally pick up music playing at the venue. To be direct about where we stand on this: The Night App does not hold a license covering commercially released music, and we don’t claim that music appearing in the background of a user’s video is automatically lawful to post just because it was incidental. Responsibility for a video’s content, including any music in it, sits with the person who uploaded it. Rights holders can report specific content using the process below, and we review reports individually rather than applying a blanket rule either way.

How to report infringing content

If you own or represent the rights to content you believe is being infringed on The Night App, use the form on this page. To help us act on it, please include:

• Your name, and the name of the company or rights holder you represent (if applicable)
• A way to contact you (email)
• A description of the copyrighted work you believe is being infringed
• The location of the allegedly infringing content — a link, username, or other way to identify it
• An explanation of why you believe this use infringes your rights
• A statement that you have a good-faith belief the use isn’t authorized by the copyright owner, its agent, or the law
• A statement, under penalty of perjury, that the information in your report is accurate and that you’re the copyright owner or authorized to act on their behalf

Submitting the form counts as your electronic signature and is timestamped automatically.

What happens after you report

Reports go into our internal moderation queue for review — not an automated takedown. Where a report appears valid, we may remove or restrict access to the content while we look into it. Accounts that repeatedly infringe copyright may have their content removed, features restricted, or their account suspended or terminated — see Content moderation and enforcement in our Terms.

If you believe content was removed or restricted in error, you can submit an appeal.

False or abusive reports

Submitting a report you know to be false or made in bad faith — for example, to harass another user or wrongfully take down legitimate content — is itself a violation of our Terms of Service and may result in restrictions on your own account.

Trademark and other IP

This same reporting process applies to trademark infringement and other intellectual property concerns, not just copyright — use the same form and describe the right you believe is being infringed.
